The planning and preparation of Wills, Trusts, Power of Attorneys, Advanced Directives, and other documents necessary for the transfer of property on death or disability. Considerations in preparing estate planning documents include, taxable estates; second marriages; minor heirs; special needs family members; probate vs. non probate issues, and education or support trusts.
Superior Court proceedings to appoint a Guardian to manage an incapacitated person’s financial and health care needs. Usually if there is elder abuse or exploitation a Guardianship is required. Represent family and professional certified Guardians.
A Court process to transfer assets following a person’s death, either under a Will if there is one, or under the intestate provisions of the State of Washington, if no Will.
Real Estate Law
Handling the transfer of real property, eviction and unlawful detainer proceedings, quiet title actions.
Assist with completion of Medicaid Applications to DSHS for long term care benefits; Filing Medicaid and Elder Abuse Appeals (APS) to the appropriate DSHS agency.
Filing litigation to contest a Will or a Guardianship; filing or defending a Vulnerable Abuse Protection action
Filing Vulnerable Adult Protection actions if necessary for financial exploitation or mental or physical abuse.
Special Needs Law
Prepare Special Needs Trusts for Court Approval; Prepare Special Needs Trusts under a Trust or Will; represent Trustees of Special Needs Trusts.
Assist Veteran’s in filing applications for benefits; appealing denial of claims.
Assist families with qualifying for state Medicaid long term care programs, including transferring of assets to spouse and qualified children.
